Content Ownership
You retain 100% intellectual property ownership of all course content, videos, tests, and student records you upload.
Fair & Transparent Billing
Subscriptions are billed based on selected tier with clear renewal timelines, no hidden charges, and transparent invoicing.
Uptime Commitment
We target a 99.9% platform availability SLA backed by automated monitoring and geo-redundant hosting.
Responsible Use
Institutes agree to use the platform legally, maintaining accurate student records and respecting copyright laws.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you (whether individually or on behalf of an educational institution, coaching center, school, or organization, "Customer", "you", or "your") and Tutora Inc. ("Tutora", "we", "us", or "our").
By accessing, browsing, creating an account, or using our website, cloud LMS, mobile applications, APIs, or related services (collectively, the "Services"), you signify your consent to these Terms and our Privacy Policy. If you do not agree with all provisions of these Terms, you must immediately discontinue using our Services.
2. Account Registration & Administrator Responsibilities
2.1 Authority: If you register an account on behalf of an educational institution or business entity, you represent and warrant that you possess the legal authority to bind that entity to these Terms.
2.2 Credentials Security: You are responsible for maintaining the confidentiality of administrative passwords, API keys, and staff login credentials. You must immediately notify Tutora of any unauthorized account access.
2.3 Student & Staff Access: The Customer is solely responsible for granting, managing, and revoking role permissions for teachers, students, and parents within their institute portal.
3. License & SaaS Usage Rights
Subject to timely payment of subscription fees and compliance with these Terms, Tutora grants Customer a non-exclusive, non-transferable, revocable subscription license to access and use the platform solely for Customer's internal educational and administrative operations.
Customer shall not: (a) reverse engineer, decompile, or attempt to extract source code from the platform; (b) resell, sub-license, lease, or distribute the platform to unauthorized third parties; or (c) use automated bots or scrapers without express written consent.
4. Intellectual Property & Content Ownership
Customer Content (Your Property)
You retain all right, title, and interest in and to all study materials, test questions, recorded lectures, student rosters, logos, and custom branding uploaded to the platform.
Tutora Platform (Our Property)
Tutora and its licensors retain all right, title, and interest in and to the platform codebase, user interfaces, documentation, trade secrets, software algorithms, and trademarks.
5. Subscriptions, Billing & Renewals
- Billing Cycle: Services are billed in advance on a monthly or annual subscription cycle as chosen at the time of purchase.
- Automatic Renewal: To avoid service disruption for active students, subscriptions renew automatically unless cancelled prior to the renewal date.
- Taxes: All listed fees are exclusive of applicable taxes (e.g., GST, VAT, sales tax), which will be itemized on your invoices.
- Fee Collection Gateways: When using integrated payment gateways for collecting student fees, standard gateway processing charges apply.
6. Acceptable Use Policy
You agree not to use Tutora to:
- Upload or distribute copyrighted materials without necessary educational rights or authorizations.
- Transmit malware, viruses, trojans, or corrupt data packages.
- Engage in harassment, abusive behavior, or non-educational spamming of students or parents.
- Attempt to bypass security limits, access tier restrictions, or bandwidth quotas.
7. Disclaimers & Limitation of Liability
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. While Tutora employs enterprise-level uptime architecture, we do not warrant that the Services will be 100% uninterrupted or error-free at all times.
To the maximum extent permitted by applicable law, Tutora shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising out of your use or inability to use the platform. Our aggregate liability shall not exceed the total fees paid by you in the 12 months preceding the claim.
8. Termination & Account Suspension
You may terminate your subscription at any time from your admin dashboard or by notifying support. Upon cancellation, you will continue to have access through the end of your prepaid billing period.
Tutora reserves the right to suspend or terminate accounts that engage in severe policy violations, fraud, or unpaid delinquent accounts after reasonable notice.
